The High Court has dismissed the petition filed against Hon. Ricky Fuo’o, the Member of Parliament for Central Kwara’ae Constituency, in a ruling delivered this morning.
The petition, filed by former MP of Central Kwara’ae Jackson Fiulaua after the election last year was found to lack substantial evidence and to have been improperly served.
Chief Justice Albert Palmer stated that the case against Hon. Fuo’o was invalid due to the failure to properly notify him of the petition case which breached essential procedural requirements that guarantee all parties a fair opportunity to respond.
Justice Palmer further stated that there was no adequate evidence to show that further attempts or procedures were followed to serve the defendant.
He emphasize the critical need for adherence to proper service protocols to maintain the integrity of the judicial process, asserting that without appropriate notification, the defendant's right to a fair trial is severely undermined.
In response to the ruling, Hon. Fuo’o expressed his gratitude to Fiulaua for exercising his democratic right to challenge him in court.
He took to his personal Facebook page to say, "I wish to thank the former MP for Central Kwara’ae for exercising his democratic right in court against me." Additionally, he urged his constituents to unite, stating, “Let’s come together hand in hand and work for the betterment of Central Kwara’ae, Malaita, and the Solomon Islands as a whole.”
